It is prohibited to use the name VisionPlan.vip, any registered logos, service marks, or trademarks owned by VisionPlan.vip or any of its subsidiaries or affiliates, as well as the materials on this website, in any publicity or for any other purpose without VisionPlan.vip’s express prior written consent (ViP).

3. DISCLAIMER OF WARRANTIES AND LIMITATIONS OF LIABILITY

Regarding the applicability of this material for any purpose, ViP provides no guarantees. 8. CONFIDENTIALITY AND SECURITY

Members of ViP should be aware that all data exchanged between their computer and ViP’s Web servers is encrypted using Transport Layer Security (TLS) 1.2. The greatest software currently available for secure transactions is ViP’s security software, which is the industry standard.

9. USE OF E-MAIL SUBSCRIPTION INFORMATION

ViP may tailor and target the content of the emails you receive from us in order to better serve you by using the email subscription data we collect. You might get information from ViP as a subscriber, such as surveys, plan, benefit, or educational information, and ViP promotions. The data won’t be shared or sold outside the ViP group of enterprises. We might give broad reports on how people use their email subscriptions, but we won’t publish email addresses or any other details that could be used to identify specific people unless we specifically say so in this document.

10. CONSENT TO CONTACT AND WIRELESS PHONE TERMS OF SERVICE

You consent to receive autodialed calls, prerecorded messages, and/or text messages from VIP, its affiliates, and third parties operating on VIP’s behalf by providing your phone number and checking the enrollment form’s applicable box. Data and text rates may apply. Ensure with your carrier, please. By answering STOP to any message, you can stop receiving text messages on your phone at any moment.

11. THE USE OF COOKIES

Personal data gathered and how it is used: ViP uses temporary session cookies to gather anonymous, non-personal data about site visitors. Cookies are tiny, alphanumeric identifiers that a user’s Web browser transfers on the computer’s hard disk, allowing VIP’s systems to identify the browser and offer customized capabilities. When you close your browser, session cookies become invalid.

When a user visits our website, VIP will gather information about their online activities that does not directly or personally identify the user. This information may comprise the content viewed by the user, the time and date at which it was viewed, the products the user purchased, or IP-assigned location data for the user. We don’t gather any personally identifiable data about users, won’t link to any protected health information, and won’t show them ads based on sensitive health information.

Additionally, VIP employs technologies like cookies and pixels to monitor your activity on our website as well as the websites of our third-party advertising partners (hereinafter referred to as “our Advertising Partners”) and may use such cookies to deliver more pertinent adverts to you. 12. THE CHILDREN'S ONLINE PRIVACY PROTECTION ACT

The Children’s Online Privacy Protection Act does not apply to VIP’s website since it does not target content towards children and does not have any plans to do so. The User agrees that he or she will be solely responsible for (a) the online behavior of such Minor; (b) monitoring such Minor’s access to and use of the Service; and (c) the results of any use if the User permits his or her minor child, or a child for whom the User is a legal guardian (a “Minor”), to access and use the features.

13. RESPONSE TIME

As soon as it’s practicable, VIP answers to emails, electronic messages, and other correspondence. VIP’s reaction time must not go beyond any legal time limits that may be established.

14. ACCESS AND INTERFERENCE

You acknowledge that using or attempting to utilize any element of the website for any commercial purpose is prohibited. You acknowledge and agree that you will not access the Site using any robot, spider, or other automated device, method, or means. You may not, without our prior explicit written consent, use any manual procedure to observe, copy, or otherwise take any action with respect to our web pages or the material that they contain. You acknowledge that you will not attempt to interfere with the correct operation of the Site by using any tool, piece of software, or routine, nor will you employ any such tool, software, or routine. You pledge not to take any action that imposes an excessive or without VIP’s prior express consent, you may not publicly display any content from the Site (apart from for your own private, non-commercial use).

15. UNAUTHORIZED USE OF THE SITE

Any misuse of the site that is prohibited by law or without authorization is prohibited by these terms of usage. You are not authorized to use the Site in any manner that goes against these Terms of Use. Unauthorized framing of or links to the Site as well as the use of robots, spiders, or other automated processes without authorization are examples of illegal or unauthorized use of the website. Additionally, it is against these Terms of Use for anybody (or a group of people working together) to request more than 100 pages of content from the Site in a single 24-hour period (hereafter referred to as “Abusive Use”).

16. SUSPECTED VIOLATION OF THESE TERMS OF USE OR LAW; INJUNCTIVE, EQUITABLE RELIEF, AND LIQUIDATED DAMAGES

Unauthorized entry or use of the website are examples of violations of these terms of use. These violations may be investigated, and appropriate legal action, including but not limited to civil, criminal, and/or injunctive remedy, may be taken. You acknowledge and agree that if VIP determines, in its sole discretion and without prior notice, that your conduct or the conduct of any other person with whom VIP believes you act in concert, or the User Content you provide, violates or is inconsistent with these Terms or the law, or infringes the rights of VIP or another user of the Site, VIP may in its sole discretion terminate your access to the Site, remove any unauthorized User Content, or exercise any other legal or equitable remedy available.  You acknowledge that monetary damages may not be an adequate remedy for a violation of these Terms by VIP, and you agree that injunctive or other equitable action may be used in such cases.

You acknowledge that using the site abusively, as described above, results in injury and damage to VIP, including diminished reputation and higher costs incurred in dealing with abusive use of the site. You additionally acknowledge that determining monetary damages for abusive use of the site is challenging and that calculating proof of monetary losses for abusive use would be expensive and burdensome. You acknowledge that abusive use justifies injunctive or other equitable action.  Therefore, you acknowledge and agree that you and those acting with you may be jointly and severally liable for reasonable legal fees, expert witness fees, and other costs related to obtaining injunctive or other equitable relief if you alone or jointly request more than 100 pages of content from the Site in any twenty-four hour period.
